Discovery of unconscious man in Chicago ends with DUI charge

There are very few people who can honestly say they are unaware of the possible dangers of drinking and driving. Driver's education classes as well as public service announcements have educated drivers about the risks they take if they choose to get behind the wheel and drive after they have had a few drinks. However, a recent case in Chicago that resulted in a DUI charge has some people wondering if it is illegal to even be in a car while allegedly intoxicated.

In the late evening of a late August day, police officers received reports of suspicious vehicle in a Chicago neighborhood. When officers arrived at the scene, they found the only occupant of the car asleep. According to police claims, the 25-year-old male appeared to be under the influence of alcohol.

As a result, a police administered both a field sobriety and breath test. They claim the man failed both. Due to his alleged performance on these tests, he was arrested. He now faces criminal charges as a result. He is due back in court in September due to the drunk driving charges due to driving with a blood alcohol level greater than .08.

Despite the charges against him, it is unclear if the man actually drove the car. Based on the information provided, the man could have simply been sleeping in his car and did not actually put anyone's life in danger. The only thing that is clear is that Chicago prosecutors will have to prove the DUI charge beyond a reasonable doubt.
